Terms of Service for DialedDaily

Effective: April 26, 2026

These Terms of Service ("Terms") govern your use of the DialedDaily mobile application ("App"). By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.

ELIGIBILITY

You must be at least 13 years old to use DialedDaily. By using the App, you represent that you meet this requirement. If you are under 18, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

YOUR ACCOUNT

You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us promptly if you suspect unauthorized access. We may suspend or terminate accounts that we reasonably believe are being used in violation of these Terms.

ACCEPTABLE USE

When using DialedDaily, you agree NOT to:

  • Create accounts using false identities or impersonate others.
  • Falsify check-in locations (e.g. by spoofing GPS) or otherwise game the streak/badge systems.
  • Harass, threaten, or abuse other users in your group.
  • Reverse engineer, decompile, or attempt to extract source code from the App.
  • Use the App to violate any law or regulation.
  • Send unsolicited messages through the nudge feature.

We reserve the right to terminate accounts that violate these rules.

USER CONTENT

You may provide a display name and select an avatar from our preset gallery. You retain whatever rights you have in this content. By providing it, you grant us a worldwide, royalty-free, non-exclusive license to display it within the App to other members of your group, and to store it on our backend, for the purpose of operating the service.

You agree not to use a display name that is harassing, hateful, sexually explicit, or that impersonates another person.

THE SERVICE IS PROVIDED "AS IS"

DialedDaily is a habit-tracking and accountability tool. It is not a medical device, a fitness coach, or a substitute for professional advice. Consult a qualified medical or fitness professional before starting any exercise program.

The App is provided "as is" and "as available," without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or completely secure.

LIMITATION OF LIABILITY

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits, data, goodwill, or use, arising out of or in connection with your use of the App. Our total liability to you for any claim relating to the App will not exceed twenty-five United States dollars (US$25.00).

TERMINATION

You may stop using the App and delete your account at any time from inside the App. We may suspend or terminate your access to the App at any time, with or without notice, if we believe you have violated these Terms or if we are required to do so by law. On termination, the rights and licenses granted to you under these Terms will end.

CHANGES TO THESE TERMS

We may update these Terms from time to time. If a change is material, we will notify you in the App and update the "Effective" date above. Continued use after a change means you accept the new Terms.

GOVERNING LAW

These Terms are governed by the laws of the State of Rhode Island, without regard to conflict-of-laws principles. Any dispute arising from these Terms or the App will be resolved in the state or federal courts located in Providence County, Rhode Island, and you consent to the personal jurisdiction of those courts.
