Terms of Service for DialedDaily

These Terms of Service ("Terms") govern your use of the DialedDaily mobile application ("App"). By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.

ELIGIBILITY

You must be at least 13 years old to use DialedDaily. By using the App, you represent that you meet this requirement. If you are under 18, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

YOUR ACCOUNT

You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us promptly if you suspect unauthorized access. We may suspend or terminate accounts that we reasonably believe are being used in violation of these Terms.

ACCEPTABLE USE

When using DialedDaily, you agree NOT to:

  • Create accounts using false identities or impersonate others.
  • Falsify check-in locations (e.g. by spoofing GPS, modifying device location, or otherwise reporting a location you are not physically at) or game the streak, goal, or badge systems. We perform server-side distance verification on every check-in.
  • Harass, threaten, or abuse other users in your group.
  • Reverse engineer, decompile, or attempt to extract source code from the App.
  • Attempt to enumerate group invite codes or otherwise discover groups you have not been invited to join.
  • Use the App to violate any law or regulation.
  • Send unsolicited messages through the nudge feature.

We reserve the right to terminate accounts that violate these rules.

USER CONTENT

You may provide a display name and select an avatar from our preset gallery. You retain whatever rights you have in this content. By providing it, you grant us a worldwide, royalty-free, non-exclusive license to display it within the App to other members of your group, and to store it on our backend, for the purpose of operating the service.

You agree not to use a display name that is harassing, hateful, sexually explicit, or that impersonates another person.

SUBSCRIPTIONS, BILLING & TRIAL

DialedDaily offers an optional auto-renewing subscription that unlocks the full feature set. Subscriptions are sold through Apple's App Store and billed to your Apple ID. We do not process payments directly and do not have access to your payment information.

Free trial. New subscribers may be offered a free trial period (typically 7 days) before the first charge. Unless you cancel before the trial ends, your subscription will automatically convert to a paid subscription and your Apple ID will be charged the then-current price. Apple will notify you before the trial ends if you have notifications enabled.

Auto-renewal. Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the end of the current period. Your Apple ID will be charged the renewal price at the start of each new period. Prices are displayed in the App before purchase.

Cancellation.You can cancel your subscription at any time from iOS Settings → Apple ID → Subscriptions → DialedDaily. Cancellation takes effect at the end of the current billing period; you will not be charged again, and you retain access to paid features until the period ends. We cannot process cancellations on your behalf.

Refunds. Refunds for App Store purchases are issued by Apple, not by us. Refund requests can be submitted at reportaproblem.apple.com. Apple's refund policy applies.

Account deletion does not cancel a subscription. If you delete your DialedDaily account while a subscription is active, the subscription will continue to bill your Apple ID until cancelled in Settings. The App displays a reminder of this before allowing account deletion when a subscription is active.

THIRD-PARTY SERVICES

The App relies on third-party services to function, including Apple Push Notification service for reminders, Apple's MapKit Server API for gym search, RevenueCat for subscription management, and Supabase for data storage. Your use of features that depend on these services is also subject to those providers' terms. We are not responsible for outages or behavior of third-party services beyond our control.

THE SERVICE IS PROVIDED "AS IS"

DialedDaily is a habit-tracking and accountability tool. It is not a medical device, a fitness coach, or a substitute for professional advice. Consult a qualified medical or fitness professional before starting any exercise program.

The App is provided "as is" and "as available," without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or completely secure.

LIMITATION OF LIABILITY

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits, data, goodwill, or use, arising out of or in connection with your use of the App. Our total liability to you for any claim relating to the App will not exceed twenty-five United States dollars (US$25.00).

TERMINATION

You may stop using the App and delete your account at any time from inside the App. We may suspend or terminate your access to the App at any time, with or without notice, if we believe you have violated these Terms or if we are required to do so by law. On termination, the rights and licenses granted to you under these Terms will end.

CHANGES TO THESE TERMS

We may update these Terms from time to time. If a change is material, we will notify you in the App and update the "Effective" date above. Continued use after a change means you accept the new Terms.

GOVERNING LAW

These Terms are governed by the laws of the State of Rhode Island, without regard to conflict-of-laws principles. Any dispute arising from these Terms or the App will be resolved in the state or federal courts located in Providence County, Rhode Island, and you consent to the personal jurisdiction of those courts.
